The POEO Act is NSW's key environment protection legislation administered by the NSW Environment Protection Authority (EPA). It establishes a system of environment protection licences for scheduled activities, creates a three-tiered structure of pollution offences (Tier 1 being the most serious), provides for clean-up and prevention notices, establishes load-based licensing, regulates waste management, and includes the container deposit scheme. Maximum penalties were doubled in 2024 under the Environment Protection Legislation Amendment (Stronger Regulation and Penalties) Act 2024, with Tier 1 offences for companies increased to $10 million (wilful) and $4 million (negligent).
